This Privacy Policy (the “Privacy Policy”) describes how Curv Labs Inc. (“Curv AI,” “Company,” “we,” “us,” “our”) collects, uses, discloses, stores, and otherwise processes personal information when you access or use our mobile application(s), website(s), computer-vision assessment tools, athlete testing features, training programs, leaderboards, directories, contests/promotions, and related services (collectively, the “Platform”).

This Privacy Policy is incorporated by reference into the Curv AI Terms of Service.


1. SCOPE; DEFINITIONS

1.1 Personal Information. “Personal information” means information about an identifiable individual, as defined under applicable Canadian privacy law.

1.2 De-identified / Anonymized Data. “Anonymized Data” means data that has been de-identified, anonymized, or aggregated such that it no longer identifies an individual.

1.3 User Data. “User Data” includes content and materials you upload to the Platform (including videos/images), performance results, and related information, as further described in the Terms of Service.


2. INFORMATION WE COLLECT

We may collect the following categories of information:

2.1 Account and Contact Information

  • name, email address, username/handle, password (hashed), and related account details.

2.2 Athlete Performance and Movement Data

  • videos and images you upload or record;
  • movement and pose data extracted via computer vision;
  • scores, metrics, comparisons, benchmarks, and progress data;
  • training history and activity logs.

2.3 Device and Technical Information

  • device identifiers, OS/app version, IP address, language settings, crash logs, diagnostic logs, and usage analytics.

2.4 Payment and Transaction Information

  • subscription status and transaction metadata (note: payment card details are typically processed by third-party payment processors).

2.5 Communications

  • support requests, feedback, and communications with us.

2.6 Contest/Promotion Information

  • entry validation data, eligibility information, and prize fulfillment information.


3. HOW WE USE INFORMATION

We use personal information to:

3.1 Provide and Operate the Platform

  • create and manage accounts;
  • process uploads and deliver assessments, scores, and training outputs;
  • provide leaderboards/directories and user-requested sharing;
  • provide customer support.

3.2 Improve and Develop the Platform

  • debug, monitor, and improve performance;
  • develop and improve Models and features;
  • generate and use Anonymized Data and analytics.

3.3 Safety, Integrity, and Compliance

  • prevent fraud, abuse, and violations of our Terms;
  • enforce policies and protect our users and business;
  • comply with legal obligations.

3.4 Marketing and Communications

  • send service-related notices;
  • send marketing communications where permitted by law and your preferences.

3.5 Contests and Promotions

  • administer contests, verify eligibility, select winners, and fulfill prizes.


4. LEGAL BASES; CONSENT

We generally rely on consent and other lawful bases recognized under applicable Canadian privacy law. By using the Platform, you consent to collection, use, and disclosure as described in this Privacy Policy. You may withdraw consent subject to legal/contractual restrictions, but this may limit your ability to use the Platform.


5. HOW WE DISCLOSE INFORMATION

We may disclose personal information:

5.1 Service Providers / Contractors

  • hosting, storage, analytics, customer support tools, payment processors, and other vendors that process information on our behalf.

5.2 User-Directed Sharing

  • if you choose to share your content or performance data with coaches, teams, directories, events, leagues, or other third parties.

  • in connection with a merger, acquisition, financing, reorganization, or sale of assets (subject to appropriate protections).

5.4 Legal and Safety

  • where required by law, legal process, or to protect rights, safety, and security.

5.5 Anonymized Data

  • we may use and share Anonymized Data for research, benchmarking, product improvement, and marketing, provided it does not identify you.


6. CROSS-BORDER PROCESSING

We may store or process information using service providers located outside your province or country. Where information is processed outside Canada, it may be subject to the laws of the jurisdiction where it is processed.


7. RETENTION

We retain personal information for as long as necessary to provide the Platform, comply with legal obligations, resolve disputes, and enforce agreements. We may retain Anonymized Data indefinitely.


8. SECURITY

We use administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is 100% secure; you use the Platform at your own risk.


9. CHILDREN AND MINORS (13–17)

The Platform is available to individuals 13+. If you are under 18, you must have parent/legal guardian consent as described in the Terms of Service. Parents/guardians may contact us to request access, correction, or deletion requests where applicable and lawful.


10. YOUR CHOICES AND RIGHTS

Depending on your jurisdiction and applicable law, you may have rights to:

  • access and obtain a copy of your personal information;

  • request deletion (subject to legal/contractual limitations);

We may update this Privacy Policy from time to time. The “Last Updated” date indicates when changes take effect. Continued use of the Platform after updates constitutes acceptance where permitted by law.
